Welcome to Good Father Publishing! The terms "we", "us" and "our" refer to Good Father Publishing LC, a Wyoming limited liability company. Good Father Publishing operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Good Father Publishing is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") constitute a legally binding agreement between you and Good Father Publishing LC. Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers, limitations of liability, mandatory arbitration, and class action waiver.
By visiting, interacting with, or using our Services, placing an order, or clicking "I accept," you expressly agree to be bound by these Terms of Service, our Privacy Policy, Return Policy, and Shipping Policy. If you do not agree to all of these Terms, you must immediately discontinue use of our Services and may not make purchases from our store.
ARBITRATION NOTICE: THESE TERMS CONTAIN AN ARBITRATION CLAUSE AND CLASS ACTION WAIVER IN SECTION 25. BY AGREEING TO THESE TERMS, YOU AGREE TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION INSTEAD OF IN COURT, AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent and warrant that: (a) you are at least the age of majority in your state or province of residence (18 years or older in most jurisdictions); (b) you have the legal capacity to enter into a binding contract; (c) all information you provide is accurate, current, and complete; and (d) you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage, and you accept full responsibility for their use.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your name, email address, billing address, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You acknowledge that Good Father Publishing may verify the information you provide and may refuse service or cancel orders if information is inaccurate, fraudulent, or violates these Terms.
You are solely responsible for maintaining the security and confidentiality of your account credentials and for all activity that occurs under your account. You agree to immediately notify us of any unauthorized use of your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
Good Father Publishing publishes and sells children's books and related products. All products are print-on-demand, meaning books are printed by our fulfillment partner (IngramSpark) only after you place an order. This may result in longer processing times than traditional retail.
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration. Print colors may vary slightly between print runs due to the nature of digital printing technology.
We do not warrant that the appearance, quality, or specifications of any products or services purchased by you will meet your expectations or be identical to samples, images, or descriptions in our online stores. All product descriptions, images, and specifications are approximate and provided for general information only.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in product or pricing information, or violations of these Terms.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Good Father Publishing reserves the right to accept or decline your order for any reason at its sole discretion, including but not limited to: product availability, errors in pricing or product information, suspected fraud, violation of these Terms, or any other reason we deem appropriate. Your order is not accepted until Good Father Publishing confirms acceptance via email confirmation. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting. Once an order is accepted and sent to our fulfillment partner for printing, we cannot accommodate cancellation requests. By placing an order, you acknowledge that print-on-demand orders cannot be cancelled once production has begun (typically within 24-48 hours of order placement).
In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made. If we cancel an order, your payment will be refunded to the original payment method within 5-10 business days.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy, which is incorporated into these Terms by reference.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export. Bulk orders (10+ copies) require prior written approval and may be subject to separate terms.
SECTION 4 - PRICES AND BILLING
All prices are in U.S. Dollars (USD) unless otherwise stated. Prices, discounts and promotions are subject to change without notice at our sole discretion. The price charged for a product or service will be the price in effect at the time the order is placed and confirmed, as set out in your order confirmation email.
Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges. You are responsible for all applicable taxes, duties, and customs fees based on your location.
We reserve the right to correct pricing errors. If we discover a pricing error after you have placed an order, we will notify you and give you the option to either: (a) proceed with the order at the correct price, or (b) cancel the order for a full refund. We are not obligated to honor pricing errors.
Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card or payment information you provide is true, correct, and complete, (ii) you are duly authorized to use such payment method for the purchase, (iii) charges incurred by you will be honored by your credit card company or payment provider, and (iv) you will pay all charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted at the time of purchase.
We use third-party payment processors (including but not limited to Shopify Payments, PayPal, and Stripe) to process transactions. Your payment information is subject to the privacy policies and terms of service of these payment processors. We do not store your complete credit card information on our servers.
SECTION 5 - SHIPPING AND DELIVERY
We partner with third-party fulfillment providers (including IngramSpark) to print and ship products. We are not liable for shipping and delivery delays caused by fulfillment partners, shipping carriers, customs processing, weather events, natural disasters, pandemics, labor disputes, or any other events outside our reasonable control.
All delivery times are estimates only and are not guaranteed. Estimated delivery times begin from the date of order confirmation, not the date of order placement.
We are not responsible for delays caused by: incorrect shipping addresses provided by you; failure to be available to accept delivery; customs delays; carrier delays; or force majeure events. Risk of loss and title for products pass to you upon delivery to the carrier.
Once we transfer products to the carrier, title and risk of loss passes to you. You are responsible for filing claims with carriers for lost or damaged shipments.
If you do not receive your order within the estimated delivery timeframe stated in your shipping confirmation, you must notify us within 30 days of the original estimated delivery date. Failure to notify us within this timeframe waives any claims related to non-delivery.
SECTION 6 - INTELLECTUAL PROPERTY
All content, materials, and intellectual property displayed on or through the Services, including but not limited to all trademarks, service marks, trade names, logos, brands, text, displays, images, graphics, illustrations, book content, product reviews, video, and audio, and the design, selection, and arrangement thereof (collectively, "Content"), are the exclusive property of Good Father Publishing LC, Will Strivers (author), our licensors, or other rights holders, and are protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws.
These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use only, subject to your compliance with these Terms. You must not:
- Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download (except for temporary caching), store, or transmit any Content without our prior written consent
- Use any Content for commercial purposes
- Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
- Frame or link to the Services without permission
- Use any automated tools (bots, scrapers, crawlers) to access the Services
- Reverse engineer or attempt to extract source code from the Services
Violation of intellectual property rights may result in immediate termination of your account, legal action, and liability for damages, costs, and attorneys' fees.
Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Good Father Publishing, Will Strivers, Shopify or any third party. Unauthorized use of the Services may be a violation of federal and state intellectual property laws, including the Digital Millennium Copyright Act (DMCA). All rights not expressly granted herein are reserved by Good Father Publishing.
All book content, including text, characters, storylines, and illustrations in "Malcolm and Martin Become Friends" and other publications, are original copyrighted works owned by Good Father Publishing LC and/or Will Strivers. Unauthorized reproduction, distribution, or public display is strictly prohibited and will be prosecuted to the fullest extent of the law.
Good Father Publishing's names, logos, product and service names, designs, and slogans, including "Good Father Publishing," "Stories That Bring Us Together," and book titles, are trademarks or registered trademarks of Good Father Publishing LC or its affiliates or licensors. You must not use such trademarks without the prior written permission of Good Father Publishing. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services (including chat features, review platforms, or social media integrations), which we neither monitor nor have any control nor input over.
You acknowledge and agree that we provide access to such tools strictly "as is" and "as available" without any express or implied warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools, including any data breaches, service interruptions, or misconduct by third-party providers.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). Your use of third-party tools may be subject to separate terms and privacy policies of those providers.
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third party functionality). We are not responsible for and make no representations or warranties regarding the content, accuracy, completeness, legality, reliability, or availability of any third-party materials or websites you choose to access. We do not endorse, monitor, or control third-party websites and are not responsible for their content, products, services, or privacy practices.
If you decide to leave the Services to access these materials or third party sites, you do so entirely at your own risk and subject to the terms and policies of such third-party websites.
We are not liable for any harm, damages, losses, costs, or expenses of any kind arising from or related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites, including but not limited to fraud, identity theft, malware, or defective products. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.
You agree to indemnify and hold Good Father Publishing harmless from any claims arising from your use of third-party websites or services accessed through our Services.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Good Father Publishing is powered by Shopify, which enables us to provide the Services to you. However, any and all sales and purchases you make in our Store are made directly with Good Father Publishing LC, not with Shopify.
By using the Services, you expressly acknowledge and agree that: (a) Shopify is not a party to any transaction between you and Good Father Publishing; (b) Shopify is not responsible for any aspect of any sales between you and Good Father Publishing, including product quality, fulfillment, shipping, refunds, or customer service; and (c) Shopify has no liability for any injury, damage, loss, cost, or expense resulting from purchased products and services or your use of the Services.
You hereby expressly and irrevocably release Shopify Inc. and its parent, subsidiary, and affiliated companies, and their respective officers, directors, employees, and agents from all claims, demands, damages, liabilities, costs, and expenses of any kind arising from or related to your purchases and transactions with Good Father Publishing or your use of the Services.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference and can be viewed on our website. Certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read, understood, and agree to both privacy policies and consent to the collection, use, and disclosure of your information as described therein.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third-party service providers (including payment processors, fulfillment partners, and shipping carriers) that may be located in other countries than where you reside, in order to provide services to you.
By using the Services, you consent to the transfer of your information to the United States and other countries which may have different data protection laws than your country of residence.

You also represent and warrant that: (i) you own or have all necessary rights to all Feedback you submit; (ii) your Feedback does not infringe any third-party intellectual property, privacy, or other rights; (iii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iv) your Feedback will comply with these Terms and all applicable laws.
We are and shall be under no obligation to: (1) maintain your Feedback in confidence; (2) pay compensation for your Feedback; (3) respond to your Feedback; or (4) use your Feedback. By submitting Feedback, you waive any moral rights or rights of attribution you may have in such Feedback.
We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.
You agree that your Feedback will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Feedback will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Services or any related website. You may not submit false, misleading, or defamatory Feedback, and you may not impersonate others or use fake identities when submitting Feedback. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Feedback.
You are solely responsible for any Feedback you make and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third-party.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies, omissions, or outdated information that may relate to product descriptions, pricing, promotions, offers, product availability, shipping charges, transit times and availability. Despite our best efforts to ensure accuracy, errors may occur.
We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order and received confirmation). We have no obligation to update, amend, or clarify information in the Services except as required by law.
In the event of a pricing or description error, we may, at our sole discretion: (a) contact you for instructions before processing your order; (b) cancel your order and notify you of cancellation; or (c) provide you with the option to complete the purchase at the correct price. If we cancel your order due to an error, we will refund any payment received.

You may access and use the Services for lawful purposes only and in accordance with these Terms. You agree not to access or use the Services, directly or indirectly:
(a) for any unlawful, fraudulent, or malicious purpose;
(b) to violate any international, federal, state, provincial or local laws, regulations, rules, or ordinances;

(e) to harm, exploit, or endanger minors in any way;
(f) to submit false, misleading, or fraudulent information;
(g) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms;
(h) to transmit, or procure the sending of, any advertising, promotional material, junk mail, spam, chain letters, pyramid schemes, or any other form of unsolicited communication;
(i) to impersonate or attempt to impersonate Good Father Publishing, our employees, another user, or any other person or entity;
(j) to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which may harm Good Father Publishing, Shopify, our users, or expose them to liability;
(k) to use the Services to transmit or distribute viruses, malware, ransomware, or any malicious code;
(l) to engage in any automated use of the Services, including robots, spiders, scrapers, or data mining tools, without our express written permission;
(m) to attempt to bypass any security features or access controls of the Services;
(n) to interfere with, disrupt, or create an undue burden on the Services or networks connected to the Services;
(o) to use the Services to collect or harvest personal information about other users without their consent;
(p) to engage in any form of commercial activity not expressly permitted by these Terms;
(q) to make fraudulent purchases, use stolen payment methods, or engage in chargeback fraud.
In addition, you agree not to:
(a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services;
(b) reproduce, duplicate, copy, sell, resell, reverse engineer, decompile, or exploit any portion of the Services without our express written permission;
(c) collect or track the personal information of others without authorization;
(d) spam, phish, pharm, pretext, spider, crawl, or scrape;
(e) interfere with or circumvent the security features of the Services or any related website, other websites, or the Internet;
(f) use the Services for any purpose that competes with or harms Good Father Publishing;
(g) use any information obtained from the Services to contact, advertise to, solicit, or sell to users without their consent.
We reserve the right to investigate violations of these Terms and cooperate with law enforcement authorities in prosecuting violators. We may report suspicious activity to appropriate authorities.
We reserve the right to suspend, disable, or terminate your account and access to the Services at any time, without prior notice or liability, if we determine in our sole discretion that you have violated any part of these Terms or engaged in conduct that we deem inappropriate or harmful.
SECTION 14 - TERMINATION
We may terminate or suspend this agreement, your account, or your access to the Services (or any part thereof) immediately, in our sole discretion, at any time and for any reason or no reason, without prior notice or liability to you. Reasons for termination may include, but are not limited to: (a) violation of these Terms; (b) fraudulent, abusive, or illegal activity; (c) prolonged inactivity; (d) upon your request; or (e) for any other reason we deem appropriate.
Upon termination, your right to use the Services will immediately cease. You will remain liable for all amounts due up to and including the date of termination. We are not liable for any loss or damage arising from termination of your access to the Services.
You may terminate your account at any time by contacting us at goodfatherpublishing@gmail.com. Upon termination by you, we will close your account but may retain your information as permitted by our Privacy Policy and required by law.
The following sections will continue to apply following any termination and survive indefinitely: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Arbitration, Class Action Waiver, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.
SECTION 15 - DISCLAIMER OF WARRANTIES
YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICES AND PURCHASE OF PRODUCTS IS ENTIRELY AT YOUR OWN RISK. THE SERVICES AND ALL PRODUCTS ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS.
The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, reliability, suitability, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Services, or by anyone who may be informed of any of its contents.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOOD FATHER PUBLISHING, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS OF ANY KIND WITH RESPECT TO THE SERVICES AND PRODUCTS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:
- ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT;
- ANY WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, VIRUS-FREE, OR ERROR-FREE;
- ANY WARRANTIES REGARDING THE QUALITY, ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICES OR PRODUCTS;
- ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE;
- ANY WARRANTIES REGARDING THIRD-PARTY CONTENT, PRODUCTS, OR SERVICES ACCESSIBLE THROUGH THE SERVICES.
WE DO NOT WARRANT THAT:
- THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
- ANY ERRORS OR DEFECTS IN THE SERVICES WILL BE CORRECTED;
- THE SERVICES OR SERVERS ARE FREE OF VIRUSES OR HARMFUL COMPONENTS;
- PRODUCTS WILL BE FREE FROM DEFECTS IN MATERIALS OR PRINTING;
- PRODUCT COLORS, QUALITY, OR APPEARANCE WILL EXACTLY MATCH IMAGES OR SAMPLES;
- PRODUCTS WILL BE DELIVERED WITHIN ESTIMATED TIMEFRAMES.
BECAUSE WE USE PRINT-ON-DEMAND FULFILLMENT, WE DISCLAIM ANY WARRANTIES REGARDING CONSISTENT PRINT QUALITY, COLOR MATCHING BETWEEN PRINT RUNS, OR PRINTING DEFECTS CAUSED BY OUR FULFILLMENT PARTNERS. WHILE WE STRIVE FOR HIGH QUALITY, SLIGHT VARIATIONS IN PRINT QUALITY ARE INHERENT TO DIGITAL PRINTING TECHNOLOGY.
Some jurisdictions do not allow the exclusion or limitation of implied warranties or conditions, so some of the above exclusions or limitations may not apply to you. In such cases, our liability will be limited to the greatest extent permitted by applicable law.
SECTION 16 - LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOOD FATHER PUBLISHING LC, ITS PARENT, SUBSIDIARIES, AFFILIATES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, SUPPLIERS, LICENSORS, SUCCESSORS, OR ASSIGNS (COLLECTIVELY, "GOOD FATHER PUBLISHING PARTIES"), OR SHOPIFY AND ITS AFFILIATES, BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY:
DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:
- LOST PROFITS, LOST REVENUE, LOST SAVINGS, OR LOSS OF BUSINESS OPPORTUNITIES;
- LOSS OF DATA, INFORMATION, OR CONTENT;
- LOSS OF GOODWILL OR REPUTATION;
- COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES;
- PERSONAL INJURY, PROPERTY DAMAGE, OR EMOTIONAL DISTRESS;
- DAMAGES ARISING FROM ERRORS, OMISSIONS, INTERRUPTIONS, DEFECTS, DELAYS, OR SECURITY BREACHES;
- DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR DATA OR ACCOUNT;
- DAMAGES ARISING FROM THIRD-PARTY CONDUCT OR CONTENT;
- DAMAGES ARISING FROM PRODUCT DEFECTS, PRINTING ERRORS, OR SHIPPING DELAYS;
WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO GOOD FATHER PUBLISHING FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
THIS LIMITATION OF LIABILITY APPLIES TO ALL CLAIMS, INCLUDING CLAIMS:
- RELATED TO PRODUCT QUALITY, DEFECTS, OR NON-CONFORMITY;
- RELATED TO SHIPPING DELAYS, LOST SHIPMENTS, OR DAMAGED GOODS IN TRANSIT;
- ARISING FROM SECURITY BREACHES, DATA LOSS, OR PRIVACY VIOLATIONS;
- ARISING FROM THIRD-PARTY ACTIONS, INCLUDING FULFILLMENT PARTNERS AND CARRIERS;
- ARISING FROM YOUR INABILITY TO USE THE SERVICES OR ACCESS YOUR ACCOUNT;
- FOR REFUND DENIALS OR DISPUTES;
- ARISING FROM ERRORS IN PRODUCT DESCRIPTIONS, PRICING, OR AVAILABILITY.
YOU ACKNOWLEDGE THAT THE PRICES WE CHARGE REFLECT THIS ALLOCATION OF RISK AND LIMITATION OF LIABILITY. WITHOUT THIS LIMITATION, WE COULD NOT PROVIDE THE SERVICES AT THESE PRICES.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, SUCH AS LIABILITY FOR FRAUD OR WILLFUL MISCONDUCT.
SECTION 17 - INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Good Father Publishing LC, Shopify, and their respective parent companies, subsidiaries, affiliates, partners, officers, directors, employees, agents, contractors, licensors, service providers, suppliers, successors, and assigns (collectively, "Indemnified Parties") from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, and expenses of any kind whatsoever, including reasonable attorneys' fees, expert witness fees, and court costs (collectively, "Claims"), arising out of or relating to:
(a) your breach or violation of any provision of these Terms or any incorporated policies;
(b) your violation of any applicable law, regulation, or third-party right, including intellectual property, privacy, or consumer protection laws;
(c) your access to or use (or misuse) of the Services;
(d) your Feedback, content, or any information you submit through the Services;
(e) your willful misconduct, negligence, or fraud;
(f) any misrepresentation made by you;
(g) your violation of the rights of any third party, including intellectual property rights, privacy rights, or contractual rights;
(h) any dispute between you and any other user of the Services;
(i) your failure to comply with any obligation you owe to third parties, including payment obligations.
You agree to cooperate fully in the defense of any Claim. We may assume exclusive control of the defense and settlement of any Claim subject to indemnification, and you will not settle any Claim without our prior written consent. Your indemnification obligations will survive termination of these Terms and your use of the Services.
We will notify you promptly of any Claim for which we seek indemnification, provided that our failure to provide prompt notice will not relieve you of your indemnification obligations unless you are materially prejudiced thereby. We may participate in the defense of any Claim with counsel of our choosing at our own expense, and you may not settle any Claim requiring non-monetary obligations from us or admission of liability on our behalf without our prior written consent (not to be unreasonably withheld).
You will cooperate fully and reasonably in the defense of any Claim, including by providing relevant documents, information, and testimony.
SECTION 18 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable by a court of competent jurisdiction, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions, which shall continue in full force and effect. If any provision is modified or severed, the remaining provisions shall be interpreted to give effect to the intent of the original provision to the greatest extent possible.
SECTION 19 - WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by authorized representative of Good Father Publishing. No waiver of any breach or default shall be deemed a waiver of any subsequent breach or default.
These Terms of Service, together with our Privacy Policy, Return Policy, Shipping Policy, and any other policies or notices posted on our website or incorporated by reference, constitute the entire agreement and understanding between you and Good Father Publishing LC and govern your use of the Services, superseding any and all prior or contemporaneous agreements, communications, understandings, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
In the event of any conflict between these Terms and any other document, policy, or statement, these Terms shall control unless expressly stated otherwise. You may not rely on any prior oral or written statements, representations, or agreements not contained in these Terms.
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
SECTION 20 - ASSIGNMENT
You may not delegate, transfer, sublicense, or assign this Agreement or any of your rights or obligations under these Terms to any other person or entity without our prior written consent, and any such attempted transfer or assignment shall be null and void and of no force or effect.
We may freely transfer, assign, sublicense, or delegate these Terms and our rights and obligations hereunder to any third party without restriction or your consent or notice to you. This includes transfers in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. Any purported assignment in violation of this section is void.
These Terms will be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
SECTION 21 - GOVERNING LAW AND JURISDICTION
These Terms of Service and any separate agreements whereby we provide you Services, and any disputes arising out of or related to these Terms or the Services, shall be governed by and construed in accordance with the laws of the State of Wyoming and the federal laws of the United States applicable therein, without regard to its conflict of law provisions.
For purposes of jurisdiction and venue, Good Father Publishing LC is headquartered in Wyoming. You and Good Father Publishing irrevocably consent to the exclusive personal jurisdiction and venue of the federal and state courts located in Wyoming for any action or proceeding arising from or relating to these Terms or the Services, and you waive any objection to such jurisdiction or venue, including any claim that such courts are an inconvenient forum.
The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms or any dispute arising hereunder.
SECTION 22 - HEADINGS
The headings and section titles used in this agreement are included for convenience and organizational purposes only and will not limit or otherwise affect the interpretation or meaning of these Terms.
SECTION 23 - CHANGES TO TERMS OF SERVICE
We reserve the right, in our sole discretion, to update, change, modify, or replace any part of these Terms of Service at any time by posting updates and changes to our website. It is your responsibility to check our website and these Terms periodically for changes.
We will notify you of any material changes to these Terms by: (a) posting a notice on the Services; (b) sending an email to the address associated with your account; or (c) other means as required by applicable law. Material changes will be effective on the date specified in the notice, which will be no less than thirty (30) days after the notice is provided, except where a shorter notice period is permitted by law or necessary to comply with legal requirements.
Your continued use of or access to the Services following the effective date of any changes constitutes your binding acceptance of the modified Terms. If you do not agree to the modified Terms, you must immediately discontinue use of the Services. The "Last Updated" date at the top of these Terms indicates when these Terms were last revised.

SECTION 25 - DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS. IT CONTAINS PROCEDURES FOR MANDATORY BINDING ARBITRATION AND A CLASS ACTION WAIVER.
25.1 Informal Dispute Resolution
Before filing a claim against Good Father Publishing, you agree to first contact us at goodfatherpublishing@gmail.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within sixty (60) days after submission, you or Good Father Publishing may bring a formal proceeding as described below.
25.2 Mandatory Binding Arbitration
You and Good Father Publishing agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or your relationship with Good Father Publishing (collectively, "Disputes") that cannot be resolved through informal dispute resolution will be resolved exclusively through final and binding arbitration, rather than in court, except that:
(a) you may assert claims in small claims court if your claims qualify and remain in small claims court; and
(b) you or Good Father Publishing may seek equitable relief in court for infringement or misuse of intellectual property rights (such as trademarks, trade dress, domain names, trade secrets, copyrights, or patents).
25.3 Arbitration Rules and Forum
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, except as modified by this section. The AAA Rules and filing forms are available online at www.adr.org or by calling 1-800-778-7879.
The arbitration will be conducted by a single neutral arbitrator. The arbitrator will have exclusive authority to resolve all Disputes, including interpretation or application of this arbitration provision and the validity, enforceability, or scope of these Terms. The arbitrator will have the authority to grant any remedy or relief that would be available in court under law or in equity.
The arbitrator's decision and award is final and binding, and judgment on the award may be entered in any court with jurisdiction.
25.4 Location and Costs
Arbitration will take place in the county where you reside unless we agree otherwise. If the claim is for $10,000 or less, you may choose whether the arbitration will be conducted: (a) solely on the basis of documents submitted to the arbitrator; (b) through a telephonic or video hearing; or (c) by an in-person hearing as established by the AAA Rules in the county where you reside.
You are responsible for paying your share of arbitration fees (including filing, administrative, hearing, and arbitrator fees) as determined by AAA Rules. However, if the arbitrator finds that the substance of your claim or relief sought is frivolous or brought for an improper purpose, the payment of all such fees will be governed by AAA Rules and we will not reimburse you for your fees.
25.5 Class Action Waiver
YOU AND GOOD FATHER PUBLISHING AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER PARTY ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A CLASS MEMBER OR REPRESENTATIVE OR IN A PURPORTED CLASS, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. NEITHER YOU NOR GOOD FATHER PUBLISHING WILL PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING.
You and Good Father Publishing agree to waive the right to a trial by jury for all Disputes.
If a court or arbitrator determines that the class action waiver in this section is void or unenforceable for any reason, or that arbitration can proceed on a class basis, then the arbitration provisions in Section 25 shall be deemed null and void with respect to such proceeding, and the Dispute must be brought exclusively in a court as described in Section 21.
25.6 Opt-Out
You have the right to opt out of this arbitration provision by sending written notice of your decision to opt out to goodfatherpublishing@gmail.com within thirty (30) days of first accepting these Terms. Your notice must include your name, address, and email address, and an unequivocal statement that you want to opt out of this arbitration agreement. If you opt out of this arbitration provision, Good Father Publishing also will not be bound by it.
25.7 Survival
This arbitration provision shall survive termination of these Terms and your relationship with Good Father Publishing.
SECTION 26 - CALIFORNIA RESIDENTS
If you are a California resident, you may have additional rights. California Civil Code Section 1789.3 provides:

SECTION 27 - FORCE MAJEURE
Good Father Publishing shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to: acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
SECTION 28 - EXPORT CONTROLS
You may not use, export, import, or transfer any products or services except as authorized by U.S. law and the laws of the jurisdiction in which the products or services were obtained. You represent that you are not: (a) located in, or a resident or national of, any country subject to U.S. embargo or other governmental sanction; or (b) on any U.S. list of prohibited or restricted parties. You will comply with all applicable export control laws.
SECTION 29 - ELECTRONIC COMMUNICATIONS
By using the Services, you consent to receiving electronic communications from us, including via email or by posting notices on the Services. These electronic communications may include notices about your account, transactional information, and marketing messages. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
You may opt out of receiving promotional emails by following the unsubscribe instructions in those emails, but you cannot opt out of receiving transactional or service-related emails.
